Job Purpose

Essential Duties and Responsibilities include support of the Contracts & Risk Attorney and Risk Department with the following:

  1. Contract Management & Compliance:
    • Support the administration of contracts and subcontracts.
    • Assist Contracts & Risk Attorney with  legal review, negotiation, drafting of special clauses for contracts, Addenda, subcontracts, purchase order terms & conditions, bids, and other standard agreements.
    • Maintain, review, and customize ConsensusDocs, FIDIC, and industry standard contracts (i.e. AIA, EJCDC, DBIA, etc.) for international and domestic subcontracting or other contract suites, as needed.
    • Review and ensure compliance with insurance and bonding requirements.
    • Review of other legal & corporate documents (including NDAs, Teaming Agreements, etc.), as needed.
  1. Worker’s Compensation & Accident Reporting & Compliance:
    • Monitor litigation and settlements.
    • Ensure compliance with OSHA reporting & investigations.
  1. Monitor Litigation with Outside Counsel:
    • Assistance with preparation for mediation and depositions
    • Liaison with outside counsel, as needed.
    • Respond to discovery requests, subpoenas, & draft releases as necessary.
    • Oversee & draft litigation memos, confidentiality agreements, and other releases.
    • Other legal issues and special projects, as necessary.
  1. Collections Compliance & Suretyship:
    • Ensure compliance with, monitor and advise on non-payment and collections deadlines.
    • Participate in Collections Committee regarding nonpayment issues, as needed/requested.
    • Support and review nonpayment notices, 255 letters, and surety bond claims.
    • Advise regarding suretyship issues, claims, and bonding issues.
  1. Motor Vehicle Compliance:
    • Review and ensure compliance with driver’s policies.
    • Review CAPs and Driver Communication Letters.
    • Maintain, and review Independent Contractor Agreements.
  1. Insurance, Accident & Claims Compliance:
    • Oversee and ensure claims reporting for companywide insurance policies.
    • Monitor and negotiate claim settlements and draft releases.
    • Due diligence for insurance renewals, as needed.
    • Maintain insurance policies and work with third party risk consultants.
    • Assist with insurance renewals, as requested.
    • Liaison with insurance professionals and brokers, as needed to resolve issues.
  1. Other Compliance:
    • Support and advise Risk Department as needed.
    • Compliance with and policy drafting for employment related issues.
    • Legal & Risk support for project related issues (ie., project letter drafting and issue analysis).
    • Assist with due diligence efforts for private equity sales, as requested.
    • Liaison with Safety and HR regarding special employment and safety issues and litigation management.
    • Other compliance duties as assigned and needed in support of the Company and Legal and Risk Departments.

Minimum Qualifications

  • Holds a Juris Doctorate (JD) with Bar Membership Preferred but Not Required; Contract review experience preferred.
  • At least one (1) year experience in a relevant field.

Other requirements

  • Some overnights are required to attend legal events and training.
  • Work closely with management on a variety of legal, risk management, and compliance issues.
  • Strong organizational, multi-tasking, and oral and written communication skills.
  • Ability to work independently to resolve problems.
  • Prior construction or engineering experience preferred.
  • Knowledge of construction, contract, construction law and lien and bond law is preferred.
  • Open and able to learn new subject matters.
  • Ability to be flexible with changing environments.

Working Conditions

This position is located in the corporate office and requires extensive time sitting at a desk. Consideration may be given to remote work possibility, but candidate must be located near a corporate office (ie., Gainesville, FL, Chattanooga, TN, Austin, TX, Raleigh, NC, West Palm Beach, FL, Ft. Meyers, FL) for in-office requirements.
